By accessing or using Beautimonial ("Service," "we," "our," "us") at beautimonial.com, you ("User," "Brand User," "you") agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not access or use our Service.

These Terms apply to:

• Brand Users (businesses/individuals who subscribe to Beautimonial)
• Anyone who accesses beautimonial.com

By creating an account or using our widget, you confirm that:

• You are at least 18 years of age
• You have the legal authority to enter into these Terms
• You will comply with all applicable laws in your jurisdiction

Beautimonial provides:

2.1 Testimonial Widget

An embeddable JavaScript widget that brands install on their websites. The widget allows their customers to:

• Submit reviews and feedback
• Beautify their testimonials using our smart processing technology
• Publish testimonials to the brand's website automatically

2.2 Dashboard

A web-based dashboard where Brand Users:

• Manage their testimonial widget
• Review and approve testimonials
• Track usage and analytics
• Configure widget settings
• Manage their subscription

2.3 Testimonial Beautification

Our technology transforms raw customer feedback into polished, professional testimonials using advanced language processing.

2.4 Gratitude Canvas Widget

An embeddable display widget showing approved testimonials on Brand User websites.

3.1 Account Creation

To use Beautimonial, you must create an account by providing:

• Valid email address
• Secure password
• Website domain for widget activation

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized account access at support@beautimonial.com

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and keep it updated.

3.4 One Account Per Domain

Each subscription covers one registered domain. Multiple domains require separate subscriptions or higher-tier plans as outlined in pricing.

3.5 Account Sharing

Account credentials must not be shared with third parties. Each account is for a single user or business entity.

4.1 Available Plans

• Subscriptions are billed monthly in advance
• Payment processed by Razorpay
• All prices shown in USD unless you select INR payment option
• Applicable taxes added at checkout

4.3 Automatic Renewal

Monthly subscriptions automatically renew on the same date each month. You will receive an email reminder before each renewal.

4.4 Plan Upgrades

Upgrading to a higher plan takes effect immediately. You are charged the new plan price from next billing cycle or prorated amount.

4.5 Plan Downgrades

Downgrading takes effect at the end of your current billing period.

4.6 Domain Changes

Each plan allows one (1) domain change per 30-day period at no extra charge. Additional domain changes within the same period may incur a fee.

4.7 Usage Limits

Beautification limits reset on the first day of each calendar month. Unused beautifications do not carry over to the next month.

Violation of this policy may result in:

• Immediate account suspension
• Permanent account termination
• No refund of subscription fees
• Legal action if warranted

6.1 Installation

You install the Beautimonial widget by adding one line of code to your website. By installing the widget, you agree to:

• Only use the widget on your registered domain
• Not share the widget code with unauthorized parties

6.2 Domain Locking

Your widget is locked to your registered domain for security. The widget will not function on domains other than your registered domain.

6.3 Widget Availability

Widget functionality is available as long as your subscription is active. If your subscription lapses:

• Widget stops collecting new reviews
• Existing testimonials remain saved
• Widget is reactivated upon renewal

6.4 Branding

The Free plan displays "Powered by Beautimonial" branding. Paid plans (Starter and above) may remove this branding in settings.

6.5 Widget Misuse

7.1 Content Ownership

• Original customer feedback belongs to the customer who submitted it
• Beautified testimonials are derived works owned by the Brand User
• Beautimonial claims no ownership over testimonial content

7.2 Content Responsibility

Brand Users are solely responsible for:

• Ensuring testimonials are genuine
• Obtaining customer consent to publish their testimonials
• Accuracy of published testimonials
• Compliance with advertising laws (FTC guidelines, ASA standards, etc.)
• Ensuring testimonials are not misleading to consumers

7.3 Content Standards

Testimonials must not contain:

• Defamatory statements
• Hate speech or discrimination
• Sexually explicit content
• Personal information of third parties without consent
• False or misleading claims
• Content that violates any law

7.4 AI Beautification Disclaimer

Our technology polishes testimonials based on the original customer input. Brand Users should review beautified content before publishing to ensure accuracy and authenticity.

7.5 Content Removal

We reserve the right to remove testimonials that violate these Terms or applicable laws, without notice.

8.1 Beautimonial Property

Beautimonial owns all rights to:

• The Beautimonial name and logo
• Our website and dashboard design
• Our widget code and technology
• Our beautification methodology
• All proprietary algorithms

8.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Use the Beautimonial widget on your registered domain
• Access and use our dashboard
• Display beautified testimonials on your website

This license is valid only while your subscription is active.

8.3 Restrictions

You may not:

• Copy, modify, or distribute our widget code
• Create derivative works based on our technology
• Reverse engineer our systems
• Remove copyright notices or branding from our code
• Use our brand name or logo without written permission

8.4 Your Content

You retain ownership of your testimonial content. By using our Service, you grant us a limited license to process, store, and display your content as necessary to provide the Service.

8.5 Feedback

Any feedback or suggestions you provide about Beautimonial may be used by us to improve the Service without compensation to you.

Your use of Beautimonial is subject to our Privacy Policy, available at: https://beautimonial.com/privacy

The Privacy Policy is incorporated into these Terms by reference.

Key points:

• We process data as described in our Privacy Policy
• You are responsible for your customers' data under GDPR/DPDP
• We act as a data processor on your behalf for end user data
• You are the data controller for testimonials collected via widget

10.1 Service Provided "As Is"

Beautimonial is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

10.2 We Do Not Warrant That

• The Service will be uninterrupted or error-free
• The Service will meet your specific requirements
• Results from beautification will always meet your expectations
• The Service will be available at all times (we aim for 99.5% uptime)
• Any errors will be corrected immediately

10.3 Technology Disclaimer

Our beautification technology uses advanced language processing. While we strive for quality results, we cannot guarantee that every beautified testimonial will be perfect. Always review content before publishing.

10.4 Third-Party Services

We are not responsible for third-party services we integrate with (Razorpay, Supabase, etc.). Their own terms and conditions apply.

11.1 To the Maximum Extent Permitted by Applicable Law

Beautimonial shall not be liable for:

• Indirect or consequential damages
• Loss of profits or revenue
• Loss of data or business
• Service interruptions
• Actions of third parties
• Force majeure events

11.2 Maximum Liability

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to Beautimonial in the three (3) months preceding the claim.

11.3 Essential Basis

These limitations are an essential element of the agreement between you and Beautimonial. Without these limitations, we could not provide the Service at current pricing.

You agree to indemnify, defend, and hold harmless Beautimonial and its team from and against any claims, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights (including intellectual property rights)
• Testimonial content you publish
• Your violation of applicable laws
• Unauthorized use of our widget
• Claims from your customers regarding testimonials you published

13.1 Termination by You

You may cancel your subscription at any time from your dashboard:

Dashboard → Billing → Cancel Plan

Cancellation takes effect at the end of your current billing period. You retain access until then.

13.2 Termination by Us

We may suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in fraudulent activity
• Misuse the Service
• Fail to pay subscription fees
• Violate our Acceptable Use Policy

13.3 Effect of Termination

Upon termination:

• Your widget stops working
• Dashboard access is removed
• Your data is retained for 90 days then permanently deleted
• You may request data export within 90 days of termination
• No refund for unused subscription period (except as per Refund Policy)

13.4 Survival

Sections 7, 8, 10, 11, 12, and 16 survive termination of these Terms.

14.1 Demo Plan (Free)

The Demo plan is free — no payment is collected, so no refund applies. If technical issues prevent you from using the widget during your trial, contact us and we'll help resolve it.

14.2 Paid Subscriptions

To request a refund:

• Subject: "Refund Request"
• Within 7 days of first payment
• State reason for refund request

Refunds are NOT provided for:

• Requests after 7 days
• Renewal charges (cancel before renewal)
• Accounts suspended for Terms violation
• Partial months

14.3 Processing Time

Approved refunds are processed within 5-10 business days to your original payment method.

14.4 Chargebacks

15.1 Right to Modify

We reserve the right to modify these Terms at any time.

15.2 Notification

For significant changes, we will:

• Send email to registered users at least 14 days before changes take effect
• Post notice on beautimonial.com
• Update the "Last Updated" date

15.3 Acceptance

Continued use of the Service after changes constitutes acceptance of the new Terms.

15.4 Disagreement

If you disagree with updated Terms, you may cancel your subscription before the effective date of changes.

16.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@beautimonial.com to attempt informal resolution. We will try to resolve disputes within 14 days.

16.2 Good Faith

Both parties agree to negotiate in good faith to resolve disputes before pursuing formal legal action.

16.3 Governing Law

These Terms are governed by and construed in accordance with applicable international laws. We aim to resolve all disputes amicably regardless of jurisdiction.

16.4 Limitation Period

Any claim must be brought within one (1) year after the cause of action arises.

16.5 Class Action Waiver

You agree to resolve disputes with Beautimonial on an individual basis and not as part of a class action.

Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Beautimonial regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights to a successor entity.

Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control including natural disasters, war, government actions, or internet infrastructure failures.
